These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “User”) and Aspenridge Creativ Inc. (“Company,” “we,” “us,” or “our”), concerning your access to and use of the website https://www.aspenridgecreativ.com (the “Site”) as well as any related services, content, or features offered through the Site.
By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

1. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not use the Site in any way that could damage, disable, overburden, impair, or interfere with the Site’s functionality or with any other party’s use of the Site.
You represent and warrant that you are at least the age of majority in your jurisdiction (typically 19 in Alberta, Canada) or that you are accessing the Site under the supervision of a parent or guardian.

Aspenridge Creativ Inc. provides professional services including marketing, lead generation, business operations automation, digital strategy, and related consulting services (collectively, the “Services”). The Site serves primarily for informational and promotional purposes.
Any specific provision of Services is subject to separate written agreements, proposals, statements of work, service contracts, or invoices (“Service Agreements”), which shall govern the scope, fees, timelines, deliverables, payment terms, and other specifics of those Services. In the event of any conflict between these Terms and a Service Agreement, the Service Agreement shall prevail.
3. No Professional Advice
All information, content, materials, and resources provided on the Site are for general informational purposes only. They do not constitute legal, financial, accounting, tax, marketing, business, technical, or other professional advice. You should consult qualified professionals before making any decisions based on information obtained from the Site. We do not accept any liability for actions taken (or not taken) based on such information.
4. Intellectual Property

The Site and all Content and Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability.
We do not warrant that the Site will be error-free, secure, free of viruses or other harmful components, or that any defects will be corrected.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Aspenridge Creativ Inc., its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Site or Services, even if advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising from or related to these Terms or the Site shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) CAD $100.
9. Indemnification
You agree to indemnify, defend, and hold harmless Aspenridge Creativ Inc., its officers, directors, employees, agents, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Site; (b) your User Submissions; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
10. Termination
We reserve the right, without notice and in our sole discretion, to terminate, suspend, or restrict your access to the Site (in whole or in part) at any time for any reason, including suspected violation of these Terms.
Upon termination, your right to use the Site ceases immediately, but provisions that by their nature should survive termination (including limitation of liability, indemnification, governing law, etc.) shall continue in effect.
11. Privacy
Your access to and use of the Site is also governed by our Privacy Policy, which is incorporated herein by reference. The Privacy Policy explains how we collect, use, disclose, and protect personal information. Please review it carefully.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be submitted to final and binding arbitration in Edmonton, Alberta, under the rules of the ADR Institute of Alberta, except where prohibited by applicable consumer protection laws. You waive any right to a jury trial or to participate in a class action.
13. Miscellaneous
These Terms, together with any Service Agreements and the Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede all prior understandings. If any provision is held invalid, the remainder shall continue in full force. Our failure to enforce any right shall not constitute a waiver.
